Logo's?

Whats legal and whats not?

I have to ask....

What is leagal to upload and what is not when it comes to LOGOs? IE: Toyota/Honda/Coke/NFL Teams/ETC/ETC???
I had the above skin up about a year ago with several different logos in it, and they were all dumped from the site, and I was told that im not allowed to upload skins with company logo's in them.

Yet I see all these wallpapers and skins that use ATI, HONDA, TOYOTA, etc LOGOS in them and im just trying to figure out where the line is drawn?

The skin i had simply had the NFL teams logo in a jewel and the color of the skin matched the teams colors, these were being downloaded like mad, but then they were removed.

Why are these allowed and my NFL skin removed? Could i use the Coke logo and make a clock for DX with it or not?

I am NOT trying to get my skins back up, as I am more then aware that the NFL is VERY possive of their logos, and i do not need to be reminded of their "rules"

I just want to get some idea about what i can and cant upload. Can someone please let me know what the rules are?

I'm not familiar with the work moderated but I can confirm the NFL is very keen on pursuing anyone using their logos without permission. WC cannot afford a run-in with such a large organisation

Fuzzy,

Im not trying to get anyones worked booted, and to be honest i dont want my skins back up, as i dont need to worry about the NFL, but i just want to be sure that its ok for me to upload things or not.

Sports logos generate lots of money where auto manufacturers don't really profit from their logos.

Ok, That sorta makes sense. So ill remake my skins with CAR logo's in them and they can pass the test?

NFL does not 'give' permission to use its logos.

Other companies/entities are less prohibitive...

Again, Im just curious, i see so many things with logo's in them, and i just want to be sure what is ok, and whats not.

I guess it all comes down to who's more protective of their logos, and who doesnt care?

That's part of the equation. It also matters whether you created the logo 100% yourself, or if it was copied and pasted from somewhere else. As long as you created it from scratch, it can fall under the definition of "fan art". Fan art will usually be accepted as long as the copyright holder does not object.

I never just "copy/paste" anything i do from anyones work. None of the NFL logo's i used were COPIED from anything, all were hand drawn by me myself.

And Yes Weaksid i do have my OWN logo, im not talking about that.

SO does that make my skins "Fan Art" now?

Again, the NFL will ALWAYS Object to anything they dont own 10000% of.

I just have never done anything with a logo on it since last years' removal of my skins, as I believed that anything with a logo would be removed.

I just was looking for a list of whats allowed and whats banned, if that is even possible?

An odd approach but I think it fits. If the logo is from a company that would give away free t-shirts with their logo on it then the company probably isn't going to mind you spreading their logo around. If a company makes money in anyway , shape, or form from their logo then it won't pass. Recently the creators of The Simpsons started to crack down on the fan art around the web. There is no such thing as fan art to them. They consider all images to be their property. Of course I found this out when I was half done with a simpsons wb. lol I am trying to finish up the pieces of a Star Trek themed skin and I wouldn't be surprised if one day I was asked to remove it and my other Star Trek related stuff. Harley Davidson is another Co that protects their logo very well. If Harley D ever gets wind of the wallpapers and such in the libraries I am certain they will be contacting someone. Anything with an HD logo on it is money in their pockets.

yeah, its not fair.. the GOOD logo's we cant use.. Or at least the ones people would LIKE..

I bet i could make a $ if i got the NFL to let me make a "offical" skin for WMP. Oh well, wont happen.

It is my understanding that WC has been down the sports team road before and organizations were opposed to the use of their logos, leading us to no longer accept them. Until we hear something similar from the auto industry, fan art using car logos will probably not be rejected on that point alone. We try to be as open as possible until it becomes a liability for WinCustomize.

ok, i've got a question too...........i'm working on a skin (again for sysmetrix)
to match one or more of Danillo's themes....i'm using some of his work as an example, but i'm making ALL the graphics from scratch.....now, is this also fanart or do i still need permission, or both ???

i already asked Bulma.......but i don't see why that is any different.......
a car logo is probably even registered, not sure about a wb skin......

 Citizen -OZZY- ...If you replicate the style of another skinners work in order to port it to a different proggy [even without cut/paste of his images] then the RIGHT thing to do is to seek and obtain consent before distributing it publicly.

Anything 'less' will have feathers ruffled and/or you being ostracized within the community...

i agree with you Jafo........i'm not planning to do something evil....
just wondering why making a car logo is fan-art and making something inspired by
a wb skin is not......i am seeking consent already, it's a long way from finished
just have too many ideas.....but it can't hurt to ask early on.......

btw....i like the choise of words "ostracized"...sounds scary enough, i'll be good
