Freighters in rival civ's ZOC?

Should unarmed freighters really be something that triggers a diplomatic "you are in my territory" penalty?

This has been brought up continually since the diplomacy was introduced, but the squeaky wheel gets the grease, so +1.

I can think of one reason , and that is send freighters in, then upgrade them into warships, but you shouldn't be able to upgrade ships in enemy influence areas anyways.
